New Italian Law: Decree‑Law 73/2025 and Waiting‑Time Compensation in Logistics

As of 19 July 2025, Italian Decree‑Law No. 73 of 21 May 2025 was formally converted into law and published in the Official Gazette. This brings a significant change to compensation rules for truck waiting times during loading and unloading operations.


Key Changes

1. Reduced Free Time (“Franchigia”)

  • Free waiting time for loading or unloading has been reduced from 120 minutes to 90 minutes (1.5 hours), starting from the vehicle’s arrival. After that, compensation applies.   

2. Mandatory Compensation

  • When the free time is exceeded, €100 per hour – or fraction of an hour – is due, automatically. This amount will be adjusted annually based on the ISTAT FOI index.   

3. Scope of Compensation

  • Compensation is owed not only for delays beyond the grace period but also when actual loading/unloading times exceed those specified in the transport contract, if documented.   

4. Solidary Responsibility

  • Committente (client) and caricatore (loading party) are jointly liable (“in solido”) for the compensation. However, internal rights to recourse are recognized. 

5. Proof of Delay

  • Carriers may establish arrival time using satellite geolocation or second‑generation smart tachograph data, even if the client fails to supply advance information on loading/unloading instructions.   

6. Driver Presence

  • Drivers must be allowed to attend and verify the loading/unloading operations, including proper cargo placement.
